Terms and Conditions
Please read the following booking conditions carefully which outline our obligations to you, and your responsibilities to us.
These terms and conditions are the entire agreement between you and Nurture Group Australia Pty Ltd (“Nurture 360”).
These terms and conditions are governed by New South Wales, Australia law and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia in respect of any dispute or proceeding.
PASSPORT AND VISAS It is your responsibility to ensure you have a valid passport (including sufficient minimum 6 months validity from return date) and any applicable visa. Should you not have sufficient validity on your passport, you may be refused to travel with no refund applicable. All extra incurred travel expenses will be the responsibility of the traveller.
COVID-19 FIJIAN ENTRY REQUIREMENTS Effective 14 February 2023, international travellers arriving into Fiji by air or sea will no longer be required to provide proof of COVID-19 vaccination and travel insurance to enter Fiji. However, it's a good idea to ensure you understand your country's latest restrictions on travelling to and from Fiji. These are fluid and may include mandatory tests and quarantine requirements upon your return.
HOW TO BOOK Contact us directly or book via our online booking system. Payment in full is required to secure your reservation together with a completed online traveller information form.
PAYMENT TERMS Once your application is approved, we will get you to complete our online traveller information form. At the same time a confirmation invoice will be issued for payment. The price you pay will depend on whether you qualify for the early bird price - to get early bird, you need to pay $1,250 deposit per attend before January 20th, 2024. All bookings and first payments done from January 21st, 2023=4 onwards will be at the standard (full) price. Full payment is required by July 24th, 2024. By paying your invoice you agree that you have read, understood and will be bound by these terms & conditions.
CANCELLATIONS Deposits paid are fully refundable within 28 days of your full payment of invoice issued for the cost of you attending our 2024 retreat. Retreat packages can be transferred without additional charge to someone else before July 24th 2024. Any package transfer after July 24th 2024 will incur a service charge of $200.
Depending on your reason for cancelling and provided your reasons fall within the terms of your travel insurance policy, subject to these terms and conditions you may be able to have these charges refunded. Consult your insurer for further details.
CANCELLATIONS (Activities) All additional add-on products sold by Nurture 360 and/or its 3rd party suppliers are non-refundable/non-changeable/non-exchangeable. These items/activities may be amended/changed within 28 days of purchasing the item/activity, however, this is at the sole discretion of Nurture 360 and/or 3rd party suppliers. Additional fees may be charged should a change be permitted. These amendments/changes are subject to availability.
Depending on your reason for cancelling and provided your reasons fall within the terms of your travel insurance policy, subject to these terms and conditions you may be entitled to a refund. Please consult your insurer for further details.
CHANGE/AMENDMENT OF BOOKINGS After final payment July 24th, 2024 (whichever comes first), changes will incur an administrative fee of $100 (or local currency equivalent) per person per change, plus any additional fees charged by 3rd party operators.
Changes/Amendments within 48 hours of departure will incur a fee of $200.00 plus any additional fees passed on by 3rd party operators.
Such changes are subject to availability and only upon full agreement by Nurture 360 Pty Ltd at our sole discretion. If your requested change is not available, normal cancellation policy applies.
PRICES The prices stated are valid from November 2023 to July 2024. For single, the retreat fees are “per person” and for twin (ie. 2 people sharing a room) the retreat fees are per room (so includes 2 people). They are quoted in the stipulated currency throughout the brochure and website eg. NZD for Nurture Change. There is no GST charged as a Nurture Business Retreat is an overseas expense incurred outside of NZ. Retreat Fees must be paid in full by the date stipulated in the invoice. Early bird pricing is only available if you pay a $1,250 deposit per attendee by January 20th, 2024. If you pay after January 21st, 2024, you will be charged the standard price (you'll pay a deposit and full payment is due by July 24th, 2024). Nurture Change reserves the right to amend prices or payment terms at any time.

WHAT’S NOT INCLUDED IN OUR PRICES
Personally incurred expenses such as souvenirs, telephone, email, laundry charges, optional activities and items of a personal nature (e.g. drinks, spa treatments etc).
Meals or accommodation whilst travelling to/from your home port.
Any travel cost incurred to/from your home port.
Any charges levied by resorts/vessels/coaches for use of their facilities.
Travel Visa’s (where required)
WHAT SHOULD YOU BRING? We recommend the following: toiletries & items of a personal nature, hat, sunscreen, camera, insect repellent, adequate clothing.
LUGGAGE/BAGGAGE Given Nurture 360 does not organise anything to do with your airfares or transfers to attend the retreat, cost of your baggage is personal to you. Nurture Group Australia Pty Ltd will not be held responsible for any loss or theft of baggage or belongings. You should ensure you have the appropriate travel insurance.
INSURANCE It is a condition of purchasing a Nurture Group Pty Ltd package that you have adequate travel insurance for you and all members of your travelling party. You should take out travel insurance at the time your booking is confirmed. Please make sure you have evidence of this at all times.
Whilst Nurture 360 exercises utmost care, in the unlikely event of an emergency, staff may use their sole discretion to call for medevac, emergency transfer or other such matters if they feel the situation warrants it. In such instances, Nurture 360 reserves the right to claim a refund of such monies from you in the first instance and your insurer is required. Ask us for travel insurance details at the time of booking if you need further information.
Nurture 360 STAFF You agree to accept the authority of Nurture 360 staff and comply with their decisions. In the event a staff member requires a passenger to leave a trip, no refund will be given. That passenger is also responsible for their return transportation costs and will have no claim against Nurture 360. Please refer to the code of conduct.
BROCHURE/WEBSITE/SOCIAL MEDIA/PHOTOGRAPHY Nurture 360 has made every endeavour with the production of its brochure, social media platforms and www.nurture360.com to ensure that the information is correct at the time the brochure was printed, the website, social media platforms information uploaded. However, prices and services set out in our brochure, social media platforms and on our website are subject to change or withdrawal without notice. You agree that any video, photograph or image taken of you during your retreat with Nurture 360 may be used by Nurture 360 and Nurture Group for promotional purposes or in our brochure, on our social media channels or on our websites without any further consent or payment.
CHANGES IN ITINERARY Nurture 360 reserves the right to make changes to an itinerary if circumstances beyond our control make it necessary, including weather and cultural conditions.
PRE AND POST TOUR TRAVEL AND ACCOMMODATION Nurture 360 is not responsible for your travel arrangements and costs incurred in getting to the point of commencement of the Nurture Business Retreat, or from the point of conclusion of the Nurture Business Retreat (unless stated otherwise in the booking inclusions). All bookings with these related carriers, hoteliers or other service providers are subject to their terms and conditions and limitations of liability imposed.
HEALTH, FITNESS & MEDICAL You should be of reasonable health and fitness and carry all required medication. You must inform Nurture 360 of any pre-existing medical conditions, including mental illness prior to travel. Nurture 360 will keep this information confidential. We may request a doctor’s certificate certifying fitness to travel. In certain circumstances, Nurture 360 may require that a carer travels with you if you have special needs or a disability. Nurture 360 reserves the right to refuse to accept passengers who we believe may not be able to safely undertake one of our Nurture Business Retreat. In the event, the resort/vessel/vehicle carrier refuse travel due to pre-existing medical conditions that have not been notified, Nurture 360 will not be liable and no refund applicable.
WHAT HAPPENS IF YOU GET COVID-19 WHILST IN FIJI Please let Hazel Ho, our on the ground retreat manager, know that you have Covid-19. Hazel will let the hotel know and they will have plans and procedures in place that can help you isolate comfortably at the resort. They will put you in touch with the relevant medical authorities. As at October 17th, 2022, hotel isolation for guests who test positive for COVID is 5 days. A "fit to fly" certificate will be issued after this isolation period to allow a return home in the event the tourist still tests positive, depending on their home country's requirements. Your negative close contacts can choose to join you in isolation or stay in their original accommodation. Negative close contacts who do not isolate must practise mask-wearing when in public spaces and ensure they test if they experience any symptoms. If they test positive, a 5-day isolation period will commence.
MATTERS OF DISPUTE In the unlikely event of any dissatisfaction with the accommodation or any other service provided by Nurture 360, you must report it immediately to Nurture 360or resort/vessel/vehicle staff so action can be taken to remedy the problem. Failure to notify Nurture 360 or resort/vessel/vehicle staff of any problem immediately may result in your ability to claim compensation from them being extinguished or reduced. Any complaint made to us after the Nurture Business Retreat should be made in writing within 28 days of holiday completion. Should the complaint not be made in writing within this time, Nurture 360 may refuse to investigate or offer any form of compensation. This will be at the sole discretion of Nurture 360 and our 3rd party suppliers/operators.
CODE OF CONDUCT The success and enjoyment of your time at the Nurture Business Retreat depend on you and others behaving in an appropriate and responsible manner. It is a condition that your conduct is compatible with the well-being and general enjoyment of others at the retreat. You agree to accept the authority of Nurture 360 staff and resort staff and comply with their authority and their directions. Nurture 360has a zero-tolerance to illegal drug use and possession, threatening or abusive behaviour, both physical and verbal, and property vandalism. If, in the absolute opinion of Nurture Business Retreat staff, your behaviour breaches this code of conduct then Nurture 360 will remove you from the retreat. If this occurs you will be responsible for your own return transport costs and you will not be entitled to any refund for the unused portion of your retreat and / or holiday. You also agree that you will have no claim against Nurture 360 or the resort.
LIMITATIONS OF LIABILITY The responsibility of Nurture 360 and/or their agents is limited. Nurture 360 acts as a tour operating company and is not a carrier, hotelier, or provider of other services such as sightseeing tours and adventure activities. All bookings are subject to the terms and conditions and limitations of liability imposed by those carriers, hoteliers and service providers. Those terms and conditions may limit or exclude liability for death, personal injury, delay and loss or damage of baggage. Nurture 360 will not be liable for any death, personal injury, delay, damage, loss, accident or additional expenses or inconvenience which may be occasioned either by reason of any defect in any resort/ vessel/vehicle, or caused through the default or negligence of any company or person engaged in conveying you or in carrying out the arrangements in connection with your trip.
Please note, the beach in front of the hotel is known to have a strong current and there is no lifeguard, so if you swim you are doing so at your own risk. Some service providers available near the hotel such as horse riding providers may not have suitable qualifications or insurance, if you choose to use these services you are doing so at your own risk. Alcohol and/or drugs and swimming do not mix, so please do not use any of the hotel's pools if you are under the influence of alcohol and/or drugs.
Nurture 360 provides physical activities such as yoga and fitness. You acknowledge that should you participate in any activity offered by Nurture 360 that there are risks involved in participating. You agree to release and discharge Nurture 360 and the instructor from any injuries sustained as a result of your participation. You agree to indemnify and hold harmless Nurture 360 and the instructor against any liability incurred as a result of such injury or loss. You agree to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on your behalf. You understand that you are giving up substantial rights, including your right to sue. You acknowledge that you are agreeing to these terms and conditions freely and voluntarily and intend that this document be a complete and unconditional release of liability to the greatest extent allowed by law.
Force Majeure: Nurture 360 will not be liable to you in the event your holiday is disrupted or terminated by reason of an unforeseeable event such as a cyclone or other adverse weather condition, military coup, political action or civil war or acts of terrorism or pandemic.
It is possible Nurture Group may need to cancel or postpone an Event for reasons beyond its control. These reasons could include but are not limited to pandemics, natural disasters or other events limiting travel to or from the site of the Event, circumstances limiting the availability or suitability of the venue, governmental regulation or orders limiting or restricting the Event or changes in economic considerations. Tickets are not refundable regardless of the reason for cancellation or postponement, however, the full price of all retreat packages shall be automatically credited to the Nurture Group event scheduled as a replacement or substitution for such Event. In the event an attendee does not want to attend the scheduled replacement event such attendee may request by written notice to receive a credit for the full amount of the original ticket for use at any other Nurture Group event, subject to availability and Nurture Group’s general policies regarding any caps or restrictions on the overall use of credits at an event. All credits issued as a result of COVID-19-related 2024 event postponements will expire by 31/12/2026. If an attendee applies a 2024 event credit toward a 2025 or 2026 event and has to eventually cancel, their reissued credit will still expire by 31/12/2026.
Your holiday may include activities such as swimming, snorkelling, diving or parasailing. You accept that these activities and others of a similar nature may involve varying degrees of risk and you take part at your own risk. You accept that Nurture 360is not responsible for any personal injury or death sustained in these activities or others undertaken whilst on your holiday.
Nothing in these terms and conditions shall be read as excluding, restricting or modifying your rights given to you under legislation in relation to the supply of goods and services including the Consumer Guarantees Act. Passengers who purchase an optional service or product do so in direct contact with the provider and rely solely on their own judgment for participation. By completing the booking you warrant that the information contained in the booking is correct.
For additional protection, we encourage attendees to purchase travel, medical, and/or trip cancellation insurance. Effective 14 February 2023, international travellers to Fiji will no longer be required to provide proof of COVID-19 vaccination and travel insurance. For additional protection, we encourage attendees to purchase travel, medical, and/or trip cancellation insurance. The attendee’s credit card may also provide certain coverage. You should check with your credit card company to see they may also provide certain coverage. Depending on your reason for cancelling and provided your reasons fall within the terms of your travel insurance policy, subject to these terms and conditions you may be able to make a claim for cancellation fees. Please consult your insurer for further details.
PRIVACY When you sign-up with Nurture Group we collect the personal information that you provide, including your email address, phone number, address and other information. All information is used for the purposes of delivering a high quality service to you, including notifying you of our holidays, special offers and for the purposes of obtaining your feedback. You have the right to access and request the correction of any personal information that we hold about you.
If you do not want to receive information from Nurture 360 you can unsubscribe at any time using the unsubscribe link in any group email you receive, or you contact us at [email protected] and we will unsubscribe you. Please note that this may mean you miss out on important information regarding our events. Your name, company name, position and email address will be visible on our Nurture 360 App and on a networking attendee list viewable to all other attendees. If you do not want to have your details visible on our app and/or attendee networking list please contact us on [email protected].
